Terms of Service

Effective date: August 26, 2025

Article 1 (Purpose)

These Terms of Service govern the rights, obligations, and responsibilities between JOCODING (the "Company") operating Nano Banana Studio (the "Platform") and users in relation to AI image generation services provided by the Platform.

These Terms also apply, to the extent not contrary to their nature, to e-commerce conducted via PC communication, mobile, and similar means.

Article 2 (Definitions)

1) "Platform" means a virtual storefront set up to allow transactions of goods and services using computers and other information and communications equipment in order to provide AI image generation services to users.

2) "User" means a member or non-member who accesses the Platform and receives services provided by the Platform in accordance with these Terms.

3) "Member" means a person who has registered as a member of the Platform and can continuously use the services provided by the Platform.

4) "Non-member" means a person who uses the services provided by the Platform without registering as a member.

5) "AI Themed Images" means images generated using AI technology based on photos uploaded by users across various themes.

Article 3 (Posting, Explanation, and Amendment of Terms)

1) The Platform posts these Terms, the trade name and representative's name, business address (including the address for handling consumer complaints), telephone number, email address, business registration number, mail-order business report number, and the person responsible for personal information management on the initial service screen (footer) for easy access by users.

2) Before a user agrees to these Terms, the Platform provides a separate linked screen or pop-up to ensure that the user can review important matters such as withdrawal of offer, generation responsibility, and refund conditions.

3) The Platform may amend these Terms within the scope permitted by applicable laws.

Article 4 (Provision and Changes of Service)

1) The Platform performs the following tasks:

  1. Provide AI themed image generation services and conclude purchase contracts
  2. Generate and provide AI themed images under concluded purchase contracts
  3. Provide download services for generated AI themed images
  4. Other tasks determined by the Platform

2) If a purchase contract concluded with a user is erroneous and needs to be changed, the Platform will immediately notify the user of the reason.

Article 5 (Suspension of Service)

1) The Platform may temporarily suspend service if reasons arise such as maintenance, replacement, breakdown of computers and information and communications facilities, or disruption of communications.

2) The Platform is liable for damages suffered by users or third parties due to temporary suspension of service under Paragraph 1, except where the Platform proves the absence of intent or negligence.

Article 6 (Purchase Application)

1) A user applies for purchase on the Platform through the following or similar methods, and the Platform must provide the following items in an easy-to-understand manner when the user applies:

  1. Upload photos and select themes to generate
  2. Detailed pricing information for each service
  3. Select payment method and make payment
  4. Quantity of images to be generated and expected processing time

Article 7 (Formation of Contract)

1) The Platform may refuse acceptance of a purchase application under Article 6 in the following cases:

  1. Where the application contains false information, omissions, or errors
  2. Where uploaded photos are not suitable for AI themed image generation
  3. Where uploaded photos infringe copyrights or violate others' portrait rights
  4. Where acceptance is judged to cause significant technical impediments to the Platform

Article 8 (Payment Methods)

Payment for AI themed image generation services purchased on the Platform may be made by any of the following available methods:

  1. Credit/debit card and bank transfer via Toss Payments
  2. Various cards such as prepaid, debit, and credit cards
  3. Payment by gift certificates contracted with or recognized by the Platform
  4. Other electronic payment methods

Article 9 (AI Themed Image Generation and Provision)

1) The Platform takes necessary measures such as AI processing and image generation to provide AI themed images, and allows users to check the generation procedure and progress.

2) The Platform specifies the generation method and expected processing time for the purchased AI themed image generation service.

3) The processing time may vary depending on the quality of uploaded photos and server conditions.

4) Retention Period for Generated Images (Important)

  • Generated images are retained only for 24 hours from the time of payment.
  • After 24 hours, all images and related data are automatically and permanently deleted.
  • Deleted images cannot be recovered; please download within the retention period.
  • The retention period cannot be extended. Regeneration requires a new payment.

Article 10 (Refunds)

If the Platform is unable to provide the purchased AI themed image generation service, it will promptly notify the user of the reason and take necessary measures to refund the amount within three business days from the date of receipt of payment.

Article 11 (Withdrawal of Offer, etc.)

1) A user who has concluded a contract for the purchase of AI themed image generation may withdraw the offer only before generation begins.

2) Returns and exchanges are not available in the following cases:

  1. Where the original photos have been altered due to reasons attributable to the user after generation is completed
  2. Where the user requests rework due to misunderstanding of the service contents
  3. Where results are not exactly identical due to the nature of AI

Article 12 (Copyright and Use Restrictions)

1) Copyright to generated AI themed images belongs to the user.

2) The Platform may analyze generated images to improve and enhance service quality, but will not provide them to third parties without the user's consent.

3) Users may freely use generated AI themed images for commercial purposes.

Article 13 (User Obligations)

Users must not engage in the following acts:

  1. Registering false information at the time of application or change
  2. Stealing others' information
  3. Uploading photos that infringe others' portrait rights
  4. Unauthorized upload of photos without copyright
  5. Uploading photos containing obscene or violent content
  6. Infringing copyrights and other intellectual property rights of the Platform or third parties
  7. Damaging the reputation of the Platform or third parties or interfering with their business

Article 14 (Dispute Resolution)

1) The Platform establishes and operates a damage compensation handling body to reflect legitimate opinions or complaints raised by users and to handle compensation for damages.

2) The Platform handles complaints and opinions submitted by users on a priority basis. If prompt handling is difficult, the Platform will immediately notify the user of the reason and the processing schedule.

Article 15 (Jurisdiction and Governing Law)

1) Any litigation regarding e-commerce disputes between the Platform and users shall be under the exclusive jurisdiction of the district court governing the user's address at the time of filing, and if no address exists, the place of residence.

2) Korean law shall apply to e-commerce litigation between the Platform and users.

These Terms take effect from August 26, 2025.
